Highlights from the IATA World Legal Symposium, Warsaw, Poland 17-19 February
One Sky Solutions had the pleasure of attending the IATA World Legal Symposium, held in Warsaw in a particularly meaningful historical setting. Nearly a century ago, the Warsaw Convention was signed in the same city, laying the foundations of a harmonised global regime for air carrier liability that has shaped international aviation law for decades.
Today, the concept of “liability” in aviation has evolved far beyond the traditional framework of passenger injury, baggage, and cargo claims. The industry now faces an increasingly complex scope of responsibility, encompassing environmental liability, passenger rights, data protection, cybersecurity, and the growing regulatory and operational implications of artificial intelligence.
The symposium explored several forward-looking questions surrounding these emerging areas of liability: what risks are enduring, which ones are new, and how are they being assessed by airline management, boards, and investors?
According to legal managers, a clear shift has occurred in the role and exposure of legal professionals. Legal teams are now far more integrated into day-to-day operations. Whereas in the past business decisions were typically discussed among stakeholders and only referred to legal counsel at a final stage for review, today legal professionals are involved from the outset of the decision-making process. This earlier and continuous involvement inevitably brings a higher degree of responsibility and potential exposure to liability.
Data protection was another key area of discussion, reflecting the fact that aviation is a highly data-driven industry. With data often described as the “new oil,” trust has become a central element. At the same time, the increasing use of artificial intelligence raises significant liability concerns, particularly in relation to how data is processed, protected, and leveraged. Cybersecurity risks were also highlighted, alongside the growing costs and limitations of insurance coverage in this area.
As in many aviation industry events, the evolution of consumer protection frameworks—often referred to as “Consumer Protection 2.0”—was also a central topic. New regulatory models, such as Canada’s APPR, and evolving interpretations of EU Regulation 261/2004 were discussed. The debate underscored the ongoing challenge for legislators to address gaps in the regulation of multimodal travel, as well as the risks associated with further harmonisation of passenger rights regimes.
For One Sky Solutions, the symposium also provided a valuable opportunity to connect in person with members of our international network of aviation law firms.
Overall, the symposium conveyed a clear message: aviation liability is no longer a static concept. It is rapidly evolving alongside technology, regulation, and global market dynamics, requiring increasingly integrated legal, operational, and technological approaches to manage it effectively.
